The Appellate Division upheld findings of the trial court regarding the responsibility of a NJ family law firm for the international abduction of a child. The attorneys were holding the child’s passport, pursuant to an agreement between the parties that neither party could travel internationally with the child without the consent of the other parent. The court found that the Law Firm wrongfully released the passport to their client, the mother, who then took the child to her home country, Spain and refused to return her to the US. The child remains in Spain as the Spanish court has restrained her from returning to the US. The child’s mother was later convicted of interference with custody and is currently incarcerated serving a 14 year prison sentence. How sad for this child who now grows up without both of her parents!
